The CLARITY Act is unlikely to pass the Senate before it recesses in August, slowing the push for cryptocurrency market structure at a time when the industry was hoping for faster progress.

The bill, officially posted on Congress.gov as HR 3633 (Digital Asset Market Transparency Act of 2025), aims to create clearer rules for digital asset markets. Senate Majority Leader John Thune said in a report that the bill is unlikely to be voted on before lawmakers go on August recess.

This does not mean that the bill is invalid.

That means an unresolved dispute over the code of ethics is currently in the process and the timeline has shifted. Democrats are reportedly pushing for stricter rules to prevent public officials from owning or profiting from digital asset transactions.

The delay is important for crypto companies waiting for market structure to clarify.

Being late does not mean your bill will disappear. But it would push back when companies might get clearer rules.

Cryptography is no longer a niche policy topic. Public officials, campaign finance, token holdings, family business interests, and digital asset trading are all part of the political debate. Even if there is broad agreement that clarity is needed in digital asset rules, this could delay the introduction of the bill.

Courts will continue to decide individual disputes. Companies will continue to seek rules that match the way digital asset markets actually operate.

That's not the ideal way to build a market.

Enforcement and litigation may clarify some issues, but they take time and vary from case to case. If lawmakers can agree on the details, broader rules could be enacted.

The CLARITY Act is one of the most visible attempts to do so.

The delays show how difficult the work is.

Encryption policy is not going smoothly, but it is progressing.

The bigger picture is not that Washington has ignored cryptocurrencies. Obviously not.

Stablecoin bills, market structure bills, SEC-CFTC discussions, custody debates, enforcement actions, and campaign finance concerns all indicate that digital assets are now a serious policy area. The problem is that important policy areas are moving slowly.

This can be frustrating for builders and investors who are used to the speed of cryptocurrencies.

But this is what it looks like when an industry moves from the edges to the political center. More people were interested, more committees were involved, and more unrelated concerns attached to the bill.

When it comes to cryptocurrencies, the coming months may be less about whether lawmakers support transparency in digital assets in theory and more about whether they can agree on political guardrails around it.

The CLARITY Act remains in place, but its pre-adjournment period appears to be ending.

Therefore, September will be the next important test.
